State Environmental Trust Funds

Addressing environmental issues can be expensive. To help defray the cost, some states have environmental cleanup trust funds for agriculture, dry cleaning, industrial launders and textiles, manufacturing, petroleum industries. Essentially a business from one of these industries pays into their respective industry’s trust fund, such as the Underground Storage Tank (UST) trust fund or Drycleaning Environmental Response Fund, to help pay for the costs of environmental remediation at a later date.

While in an ideal world, your state trust fund will pay for all environmental costs, that’s not always a viable option. However, there is an additional funding option–your historical commercial general liability policies. By conducting insurance archeology, you can track down your historical policies and use them as funds to help pay for environmental costs, such as investigation, remediation, and legal fees.
